Terms of Service

These Terms of Service ("Terms") govern your use of the moltenflow.ai voice AI assistant service ("Service") operated by Moltenflow AI ("we", "us", or "our"). By using our Service, you agree to these Terms.

1. Service Description

Moltenflow AI provides a voice-first AI assistant that communicates with you via phone calls and SMS. The Service includes:

• AI-powered voice conversations via telephone
• SMS-based communication with your AI agent
• Integration with third-party services you authorize (email, calendar, etc.)
• Proactive communications such as daily briefings (where enabled)

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use this Service. By using the Service, you represent that you meet these requirements.

3. Account and Access

To use the Service, you must provide a valid phone number and email address. You are responsible for:

• Maintaining the security of your account and associated phone number
• All activity that occurs through your account
• Promptly notifying us of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm others
• Transmit malicious content or attempt to compromise the Service
• Reverse engineer, decompile, or attempt to extract the source code of our Service
• Use the Service for automated bulk communications or spam
• Impersonate another person or entity through the Service
• Attempt to manipulate, jailbreak, or circumvent the AI agent's safety guidelines
• Use the Service for any illegal activity

5. Voice Calls and SMS

By providing your phone number and using the Service, you expressly consent to:

• Receiving voice calls from your AI agent, including calls initiated by the agent
• Receiving SMS messages from the Service, including authorization links, notifications, and agent communications
• The recording and transcription of voice calls for the purpose of providing the Service

Standard message and data rates may apply. Message frequency varies based on your usage and agent configuration (e.g., daily briefings, notifications, and responses to your requests).

You can opt out of SMS messages at any time by texting STOP to your agent's phone number. After opting out, you will receive a confirmation message and no further SMS messages will be sent unless you re-subscribe.

6. Third-Party Integrations

The Service may connect to third-party services (e.g., Gmail, Google Calendar, Slack, GitHub) that you authorize via OAuth or similar mechanisms. By authorizing these connections:

• You grant us permission to access and perform actions on those services on your behalf, as directed by you through voice or text interactions with your agent
• You acknowledge that your use of third-party services is also governed by their respective terms of service
• You may revoke access to any connected service at any time

7. AI Agent Limitations

Your AI agent is powered by artificial intelligence and, while capable, has limitations:

• Responses may occasionally be inaccurate or incomplete
• The agent may misunderstand spoken instructions, especially in noisy environments
• The agent does not provide professional advice (legal, medical, financial, etc.) and should not be relied upon as such
• Actions taken by the agent on connected services are performed at your direction and risk

You are responsible for reviewing and confirming significant actions before or after your agent performs them.

8. Pricing and Payment

Access to the Service is provided on a subscription basis. Details of available plans, pricing, and voice minute allocations will be communicated during onboarding. We reserve the right to modify pricing with 30 days' notice. Usage beyond your plan's included allocation may incur additional charges.

9. Intellectual Property

The Service, including its technology, software, design, and branding, is owned by Moltenflow AI and protected by applicable intellectual property laws. You retain ownership of your data and content. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied
• We do not guarantee uninterrupted, error-free, or secure operation of the Service
• We are not liable for actions taken by your AI agent on connected services at your direction
• Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

11. Indemnification

You agree to indemnify and hold harmless Moltenflow AI from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

Either party may terminate the Service at any time. You may cancel by contacting us at hello@moltenflow.ai. We may suspend or terminate your access if you violate these Terms. Upon termination:

• Your agent will cease making and receiving calls
• Connected service authorizations will be revoked
• You may request export of your conversation history for 30 days following termination
• After 30 days, your data will be permanently deleted

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through your agent. Continued use after changes take effect constitutes acceptance. If you disagree with the updated Terms, you may terminate your account.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
